CANCELLATION & FREEZE POLICY

The following are policies for Tapout Fitness. Please refer to your copy of the
Membership agreement for specific details regarding your membership.

FREEZE POLICY

As a courtesy, we offer our members the opportunity to freeze their memberships. When the membership is frozen no dues will be collected nor will any members of the family have access to the facility. All family members that are participating in programming while the account is frozen will be subject to pay non-member rates for that period of time. If a member of the family would like to use the center while the account is frozen, they will be subject to the daily member guest fee.

It is the responsibility of the member to submit their freeze request 10 business days prior to billing in order to prevent full membership dues from being charged. In the event that less than 10 business day’s notice is given, we cannot guarantee to prevent the billing from processing for that cycle; however your monthly dues will be adjusted in the month that you return. These circumstances are not eligible for a refund.

Month to Month members have the ability to freeze their membership up to 3 months per calendar year.
Paid in Full and Annually Committed members have the ability to freeze their membership for up to 3 months per one year commitment. Your membership agreement will be extended by the length of time the account is frozen.

The membership account must be in good standing to be eligible for a freeze. Frozen accounts cannot be deactivated. The account must be frozen in 1 month increments and must have a specified start and end date. The full amount of freeze fees will be billed upon the submission of the freeze request. Freeze fees are $4.00 per month. Documentation may be requested upon freeze request. No account will be frozen for a period longer than the 3 month maximum without documentation of extenuating circumstance and will be up to the discretion of the management team. Upon completion of the freeze, the regular payments will be due without prior notification. If your membership agreement is on draft, the payments will be drafted automatically.

You may visit your nearest location or contact ABC Financial for assistance with your membership. Any information sent to ABC Financial Services, Inc. must include your 9 digit membership agreement number.

CANCELLATION POLICY

ALL CANCELLATION REQUESTS MUST BE RECEIVED IN WRITING. EMAIL REQUESTS CANNOT BE ACCEPTED.

CANCELLATION POLICY WITHIN 3 DAYS
You may cancel this contract at any time before midnight of the third operating day after receiving a copy of this contract. If you choose to cancel this contract, you must either:

  1. Send a signed and dated written notice of cancellation by registered or certified mail, return receipt requested; or
  2. Personally deliver a signed and dated written notice of cancellation to: TAPOUT FITNESS, Att: Cancellations, 139 W. 32nd Street, New York, NY 10001

If you cancel this contract with in the three-day period, you are entitled to a full refund of your money. If the third operating day falls on a Sunday or a holiday, notice is timely given if it is mailed or delivered as specified in this notice on the next operating day. Refunds must be made within 15 days of receipt of the cancellation notice to the health club. “Operating Day” means any calendar day on which patrons may inspect and use the health club’s facilities and services during a period of at least eight hours, except on holidays and Sundays.

CANCELLATION OUTSIDE 3 DAY WINDOW
To cancel a Month to Month membership, send written notice containing the canceling member’s name by certified or registered mail to TAPOUT FITNESS, 139 West 32nd St, New York, NY 10001 OR visit your Tapout Fitness location and fill out a Cancellation Request Form in person with a club representative. Cancelation request received via email or through the website will not be accepted.

A Cancellation Notice postmarked 30 days or more before your next Monthly Payment due date will be effective 30 days after the upcoming Monthly Payment due date. During that period, we will apply the prepaid last monthly payment made when this agreement was originally executed, if applicable. If the start date of your membership, precedes August 1, 2016, the cancellation must be received 10 days prior to your next Monthly Payment.

A Cancellation Notice postmarked less than 30 days (10 days if your start precedes August 1, 2016) before your next Monthly Payment due date will be charged an additional Monthly Payment, the membership will continue as scheduled for an additional monthly period, and the cancellation will be effective 30 days after the expiration of such additional monthly period. The membership will be extended and club access shall continue through the cancellation effective date, however, no refunds of any prepaid amounts or other amounts shall be due, except for your Cancellation Rights in Paragraphs 2(a) through (d). If you cancel the Primary membership, all memberships under this Contract will also be cancelled at that time.

CANCELLATION OF MEMBERSHIP IN TERM
A cancellation fee will apply if you cancel your membership before the terms of the agreement are satisfied. The cancellation fee will be determined by the location of the club and original term of the membership being cancelled and will range from $29 – $149.
